App Terms of Use.

Last updated: October 20, 2026. Plain language wherever possible — if anything’s unclear, just email me.

These terms cover the apps I make and sell as BassEducation:

BassEducation Metronome
BassEducation Tuner
BassEducation Ear Trainer
BassEducation Composer
BassEducation Fretboard
ManiFest: Gig & Tour Planner

They apply on every platform and store where these apps are available. I’ve kept them in plain language. If anything’s unclear, email me at support@basseducation.com.

By downloading or using one of my apps, you agree to these terms. My website, courses and memberships have their own Terms of Service. How my apps handle your information is covered in my Privacy Policy.

Who I am

The apps are made by me, Damian Erskine, and published under BassEducation.com.

Your licence

When you buy or download one of my apps, I give you a personal, non-exclusive, non-transferable licence to use it on devices you own or control, within the limits set by the store you got it from. You’re getting the right to use the app. The app itself, including its code, design, sounds and written content, stays mine (or my licensors’).

Please don’t copy, resell, rent out or redistribute the apps, or try to get around how they’re licensed. Except where the law allows, please don’t reverse-engineer them either.

Where you got the app matters

Apple App Store: Apple’s standard Licensed Application End User License Agreement also applies. Apple handles payments, in-app purchases, Family Sharing and refunds.

Setapp: Setapp’s Terms of Use also apply. Setapp handles payments, licensing and refunds.

Other stores (such as Google Play): that store’s terms also apply.

Where these terms and a store’s terms disagree about payments, refunds or installing the app, the store’s terms win. I can’t issue refunds myself for purchases made through a store. If you’re having trouble, though, email me and I’ll help however I can.

Features and editions

An app’s features can differ between iPhone, iPad, Mac and Android, and between the versions sold in different stores. Each store’s listing describes what that version includes. I update my apps regularly, and features can be added, changed or retired along the way.

Sounds and content

The click sounds, drum and percussion samples, voice counts, drones and other content inside my apps are for use with the apps. Some are licensed from professional sound designers on that basis. Practising, teaching, performing and recording with the apps is exactly what they’re for. What’s not allowed is extracting the sound files themselves, or redistributing them: on their own, in a sample library, or inside other software.

Things you create and share

Grooves, sound sets and other things you create in my apps are yours. When you share one, the link or file carries the data itself, so anyone who has it can open it. Share with care, and remember you’re responsible for what you share.

ManiFest

ManiFest stores your gig information online so your band can see it.

— Only upload things you have the right to share, including other people’s contact details and documents.
— Never upload anything unlawful or abusive.
— I may remove content, or suspend an account, that breaks these terms.
— You can delete your account at any time in ManiFest’s Settings.

Your data and backups

My practice apps keep your settings and saved work on your device, not on my servers. That keeps it private, but it also means deleting an app or losing a device can lose that data. Where an app offers export or backup, use it to keep a copy.

Updates and availability

I’ll keep improving the apps. I can’t promise that every feature, platform or operating-system version will be supported forever, or that an app will stay available in every store.

No warranty

The apps are provided “as is” and “as available.” I work hard to make them accurate and reliable, but I can’t guarantee they’ll be free of bugs or interruptions, or right in every situation. To the extent the law allows, I make no other promises or warranties about them.

Limit of liability

To the extent the law allows, I’m not responsible for indirect or consequential losses from using, or not being able to use, my apps (for example, lost data, lost work or lost income). My total responsibility for any claim about an app is limited to the amount you paid for that app.

Nothing in these terms takes away rights you have under consumer law that can’t legally be waived.

Ending

You can stop using an app at any time by deleting it. If you break these terms, your licence to use the app ends. The sections on ownership, sounds and content, no warranty and limit of liability still apply after that.

Changes to these terms

I may update these terms from time to time. The date at the top shows the latest version, and if a change is significant, I’ll say so on this page. If you keep using the apps after a change, you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules, except where your local consumer law says otherwise.
